On February 14th, prosecutors from 14 states in the United States filed a lawsuit questioning whether Musk and his “Department of Government Efficiency” (DOGE)’s “broad powers” violated the US Constitution. According to relevant litigation documents, the state prosecutor believes that the president cannot delegate such immense power to an unelected and unconfirmed individual. According to the US Constitution, generally speaking, any important official of the US government needs to be confirmed by the US Senate. The White House describes Musk as the head of the “Government Efficiency Department” and a “special government employee”. The state attorney general stated that the court should prohibit Musk from issuing orders to any executive branch personnel outside of the “Government Efficiency Department” and declare his actions to have no legal effect.
