On February 8, the Shanghai Internet Information Office and other departments jointly announced the Administrative Measures for the Negative List of Data Outbound in China (Shanghai) Pilot Free Trade Zone and New Lingang Area (Trial), and the Administrative List of Data Outbound in China (Shanghai) Pilot Free Trade Zone and New Lingang Area (Negative List) (Version 2024). The Negative List coordinates development and security, adheres to the bottom line of national data security, promotes the orderly flow and development of data resources on the basis of safeguarding important data security and protecting personal information rights, and promotes the high-quality development of the digital economy and digital trade. Relevant units in Shanghai will focus on the following aspects of work: firstly, requiring data processors to fulfill their data security protection obligations and ensure the security of data export. If a data export security incident occurs or an increase in data export security risks is discovered, it shall be reported to the Municipal Cyberspace Administration, Municipal Data Bureau, Municipal Public Security Bureau, Municipal National Security Bureau, Free Trade Zone Management Committee, and Lingang New Area Management Committee. Secondly, the Management Committee of the Pilot Free Trade Zone and the Lingang New Area will track and supervise the implementation of the negative list and the export of data within the zone, and strengthen the supervision of the entire chain and field before, during, and after the event.
